These terms govern your use of the Tuell Realty, LLC website and the AgentHub mobile app (the "App"). By using either, you agree to them. If you don't agree, please don't use them.
1. Website
The site is for general information, is not legal or financial advice, and does not create an agent-client relationship. Listing, market, and price information, if shown, may change and is not guaranteed.
2. Who may use the App
The App is intended for real estate professionals aged 18 or older. You are responsible for your account, keeping your password secure, and all activity under it. During private testing the App is provided free and may change or end at any time.
3. Your data and content
You keep ownership of everything you put into the App, including client information, documents, photos, and notes. You give us permission to store and process it only to operate the App for you, as described in our Privacy Policy. You promise that you have the right to use and upload this content, including client contact details, and that you will follow applicable laws (such as privacy, anti-spam, telemarketing, and "do not call" rules) and your broker's policies.
4. Acceptable use
Do not use the App to break the law, send unlawful or harassing messages, discriminate in violation of the Fair Housing Act or similar laws, post content you don't have rights to (for example another brokerage's listing photos), attempt to access another user's data, interfere with the service, or reverse engineer it.
5. AI features and your responsibility
The App uses artificial intelligence to draft text and read documents. AI output may be inaccurate or incomplete. You must review it before use. Contract dates, amounts, and deadlines extracted by AI must be verified against the source document. The App is a productivity tool, not legal advice, a substitute for your broker's or attorney's guidance, or a compliance guarantee. You are solely responsible for content you send or publish and for meeting all licensing, advertising, and disclosure requirements, including broker review where required.
6. Third-party services
Some features rely on third parties (for example Apple, Supabase, Anthropic, OpenAI, Shotstack, Ayrshare, and social platforms). Their availability and terms apply, and we are not responsible for their services.
7. Subscriptions
When paid plans are offered, pricing, free-trial terms, renewal, and cancellation will be shown before you subscribe and will be managed through your Apple ID or other store account. Apple's terms govern billing and refunds.
8. Termination
You may stop using the App and delete your account at any time in Settings. We may suspend or end access if you break these terms or to protect the service or other users.
9. Disclaimers
The website and App are provided "as is" and "as available," without warranties of any kind, to the fullest extent the law allows. We do not promise uninterrupted or error-free service or that data will never be lost. Keep your own copies of documents that matter.
10. Limitation of liability
To the fullest extent permitted by law, Tuell Realty, LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, deals, or data, arising from your use of the website or App. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or $100.
11. Changes
We may update these terms and will post the new date here. Continuing to use the website or App after a change means you accept it.
12. Governing law
These terms are governed by the laws of the State of Indiana, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts located in Harrison County, Indiana.
